Article 1 - Definitions
In these terms and conditions, the following definitions apply:
- Additional Agreement: an agreement related to a distance contract.
- Cooling-off Period: the period during which the consumer may exercise the right of withdrawal.
- Consumer: a natural person who is not acting for business purposes.
- Day: calendar day.
- Digital Content: data produced and supplied in digital form.
- Duration Agreement: an agreement for the regular supply of goods.
- Durable Medium: any tool that enables information to be stored.
- Right of Withdrawal: the possibility for the consumer to withdraw from the agreement.
- Entrepreneur: Modatal.
- Distance Agreement: an agreement concluded through online sales.

Article 3 - Applicability
- These terms and conditions apply to every offer and every agreement.
- The terms and conditions are made available prior to concluding the agreement.
- In the event of conflicting provisions, the most favorable provision for the consumer shall prevail.
Article 4 - The Offer
- The offer includes a clear description of the products.
- Images represent the products truthfully.
- Obvious errors or mistakes do not bind the entrepreneur.
Article 5 - The Agreement
- The agreement is concluded after acceptance and payment.
- The entrepreneur confirms the order by email.
- The entrepreneur reserves the right to refuse an order for valid reasons.
Article 6 - Right of Withdrawal
- The consumer has a cooling-off period of 14 days.
- The cooling-off period starts after receipt of the product.
Article 7 - Consumer Obligations During the Cooling-off Period
- The consumer must handle the product with care.
- The consumer is liable for any reduction in value caused by improper use.
- The consumer is not liable for any reduction in value if the entrepreneur has failed to provide all legally required information about the right of withdrawal.
Article 8 - Exercising the Right of Withdrawal
- The withdrawal must be reported within 14 days.
- The product must be returned within 14 days after notification.
- Return shipping costs are borne by the consumer.
Article 9 - Obligations of the Entrepreneur Upon Withdrawal
- Refunds will be made within 14 days.
- Refunds will be processed using the same payment method.
Article 10 - Exclusion of the Right of Withdrawal
- Hygienic products if the seal has been broken
- Personalized or custom-made products
- Digital content once delivery has started
Article 11 - The Price
- All prices include VAT.
- Shipping costs are communicated in advance.
Article 12 - Compliance and Additional Warranty
- Products comply with the agreement.
- Additional warranty does not affect statutory rights.
Article 13 - Delivery and Execution
- Delivery is carried out with due care.
- The consumer will be informed in case of delay.
Article 14 - Duration Transactions
- Termination is possible with one month’s notice.
Article 15 - Payment
- Payment is made via the available payment methods.
Article 16 - Complaints Procedure
- Complaints can be submitted via info@modatal.com.
- Complaints will be answered within 14 days.
Article 17 - Disputes
- Dutch law applies.
Article 18 - Additional Provisions
Additional provisions may not be to the detriment of the consumer and must be agreed upon in writing.
