Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  1. Additional Agreement: an agreement related to a distance contract.
  2. Cooling-off Period: the period during which the consumer may exercise the right of withdrawal.
  3. Consumer: a natural person who is not acting for business purposes.
  4. Day: calendar day.
  5. Digital Content: data produced and supplied in digital form.
  6. Duration Agreement: an agreement for the regular supply of goods.
  7. Durable Medium: any tool that enables information to be stored.
  8. Right of Withdrawal: the possibility for the consumer to withdraw from the agreement.
  9. Entrepreneur: Modatal.
  10. Distance Agreement: an agreement concluded through online sales.

Article 2 - Identity of the Entrepreneur

Article 3 - Applicability

  1. These terms and conditions apply to every offer and every agreement.
  2. The terms and conditions are made available prior to concluding the agreement.
  3. In the event of conflicting provisions, the most favorable provision for the consumer shall prevail.

Article 4 - The Offer

  1. The offer includes a clear description of the products.
  2. Images represent the products truthfully.
  3. Obvious errors or mistakes do not bind the entrepreneur.

Article 5 - The Agreement

  1. The agreement is concluded after acceptance and payment.
  2. The entrepreneur confirms the order by email.
  3. The entrepreneur reserves the right to refuse an order for valid reasons.

Article 6 - Right of Withdrawal

  1. The consumer has a cooling-off period of 14 days.
  2. The cooling-off period starts after receipt of the product.

Article 7 - Consumer Obligations During the Cooling-off Period

  1. The consumer must handle the product with care.
  2. The consumer is liable for any reduction in value caused by improper use.
  3. The consumer is not liable for any reduction in value if the entrepreneur has failed to provide all legally required information about the right of withdrawal.

Article 8 - Exercising the Right of Withdrawal

  1. The withdrawal must be reported within 14 days.
  2. The product must be returned within 14 days after notification.
  3. Return shipping costs are borne by the consumer.

Article 9 - Obligations of the Entrepreneur Upon Withdrawal

  1. Refunds will be made within 14 days.
  2. Refunds will be processed using the same payment method.

Article 10 - Exclusion of the Right of Withdrawal

  • Hygienic products if the seal has been broken
  • Personalized or custom-made products
  • Digital content once delivery has started

Article 11 - The Price

  1. All prices include VAT.
  2. Shipping costs are communicated in advance.

Article 12 - Compliance and Additional Warranty

  1. Products comply with the agreement.
  2. Additional warranty does not affect statutory rights.

Article 13 - Delivery and Execution

  1. Delivery is carried out with due care.
  2. The consumer will be informed in case of delay.

Article 14 - Duration Transactions

  1. Termination is possible with one month’s notice.

Article 15 - Payment

  1. Payment is made via the available payment methods.

Article 16 - Complaints Procedure

  1. Complaints can be submitted via info@modatal.com.
  2. Complaints will be answered within 14 days.

Article 17 - Disputes

  1. Dutch law applies.

Article 18 - Additional Provisions

Additional provisions may not be to the detriment of the consumer and must be agreed upon in writing.
